From the opinion of
Mr Attorney General Smale
it would
appear
that in
neither the bovernor of Stoughtong un the Superintendent of Trade power of pardon
is vested the
or remission in there
Cares.
The Prisoner under Consular Sentence is thus
placed at a disadvantage I with his fellow-offenders
convicted before the Courts the Colony; and as it does arise at times that these
of
latter
pardon
are
thought deserving of
or remission (with which view Ordinance N1 of 1860
was
specially enacted) so it may happen similarly with prisoners from the Consulen
"Ports.
I think it advisable that
either Her Majesty's Minister on the Governor of the Colony
Colorry Hold be empowered to deal with these cares, and shall be obliged by your Grace's directions
in the matter.
